Interesting HR&CE legal case on Othuvar salary

The Madras High Court Bench here has quashed a Government Order passed by Tamil Development, Culture and Religious Endowments Department on October 11, 2006 denying higher pay scale to a section of employees of Bhagavathi Amman Temple in Agastheeswaram Taluk of Kanyakumari district after terming it to be a 'minor temple.'

Disposing of a writ petition filed by an Othuwar of the temple, Justice K. Ravichandra Baabu rejected the argument that it was a minor temple. He pointed out that information obtained by the petitioner under the Right to Information Act 2005 disclosed that its name was found in the list of major temples under the control of Tamil Nadu Hindu Religious and Charitable Endowments (HR and CE) Department.

Revision of pay scale

The judge said that the petitioner, M. Balasubramaniam, was appointed as Othuwar in the temple on September 1, 1983 on a basic pay of Rs. 265.

In May 2004, the Government revised the pay scale for 'othuwar' category employees by fixing the basic pay at Rs. 3,200 with effect from July 1997.

Hence, he made a representation to the government to re-fix his salary.

But it was not considered and hence he filed a writ petition in 2005.

The High Court disposed of that writ petition after recording the HR and CE Department's stand that the representation was rejected on the ground that he was a temporary employee.

Thereafter, the petitioner filed another writ petition which was disposed of with a direction to the department to take an appropriate decision on the petitioner's plea after ascertaining whether he was a temporary or a permanent employee.

Subsequently, the Government Order under challenge in the present writ petition was passed stating that the petitioner was not entitled to higher pay scale as Bhagavathi Amman Temple was not a major temple and that the petitioner had given an undertaking at the time of joining service that he would not claim the scale of pay fixed for Othuwar working in major temples.

Rejecting both the reasons given by the government, Justice K. Ravichandra Baabu said that the question of major or minor temple ought not to have been raised as the high court while disposing of an earlier writ petition had ordered only to determine whether the petitioner was a permanent or a temporary employee.

Therefore, he remitted the matter back to the government for reconsideration within six weeks.

On the contention that the petitioner had given an undertaking, the judge said that such undertaking could not be used to prevent the petitioner from claiming his rights in the manner known to law.

பல கோடி மதிப்புள்ள கோயில் நிலம் ஆக்கிரமிப்பில் இருந்து மீட்கப்படுமா?

இந்து சமய அறநிலையத் துறையின் கீழ் உள்ள பெருந்துறை ஸ்ரீ செல்லாண்டியம்மன் திருக்கோயிலுக்குச் சொந்தமான பல கோடி ரூபாய் மதிப்புள்ள நிலம் மற்றும் கட்டடங்கள் பல ஆண்டுகளாக தனியாரின் ஆக்கிரமிப்பில் இருந்து வருகின்றன. இவற்றை மீட்க நடவடிக்கை எடுக்க வேண்டும் என பெருந்துறை மக்கள் தெரிவிக்கின்றனர்.
ஈரோடு மாவட்டம், பெருந்துறையின் மையப் பகுதியில் உள்ளது அருள்மிகு ஸ்ரீ செல்லாண்டியம்மன் திருக்கோயில். கொங்கு வேளாளக் கவுண்டர்களின் ஒரு பிரிவினரான காடை குலம், மேதி குலம் மக்களின் குலதெய்வமான இக்கோயில் கடந்த 1969ஆம் ஆண்டு இந்து சமய அறநிலையத் துறையின் கீழ் கொண்டுவரப்பட்டது.
இக்கோயிலுக்குச் சொந்தமான 10.87 ஏக்கர் நிலம் பெருந்துறையின் பழைய பஸ் நிலையம் அருகே கோவை- சேலம் தேசிய நெடுஞ்சாலை அருகே உள்ளது. இதன் தற்போதைய சந்தை மதிப்பு சுமார் ரூ.300 கோடிக்கும் மேல் இருக்கும் எனக் கூறப்படுகிறது.
இந்த நிலத்தில் 30-க்கும் மேற்பட்ட கடைகள் மற்றும் தனியார் பள்ளி, பெட்ரோல் பங்க்குகள் என சுமார் 50 வாடகைதாரர்கள் உள்ளனர். இவர்களில் பலர் நீண்ட காலமாக வாடகை செலுத்தாமல் உள்ளதாகக் கூறப்படுகிறது. இதே பகுதியில் பேரூராட்சிக்குச் சொந்தமான கடைகள் ஒரு சதுர அடி ரூ.115 வரை வாடகைக்கு ஏலம் கேட்கப்பட்டுள்ளன.
ஆனால், கோயில் நிலத்தை அனுபவித்து வருபவர்கள், ஒரு சதுர அடிக்கு 66 பைசா மட்டுமே வாடகை செலுத்தி வருவதாகக் கூறப்படுகிறது. இதைக்கூட பல ஆண்டுகளாக பலர் செலுத்தவில்லை என்பதும் குறிப்பிடத்தக்கது.
இவ்வாறு அறநிலையத் துறைக்குச் செலுத்த வேண்டிய வாடகை பாக்கி மட்டும் ரூ.4 கோடிக்கு மேல் இருக்கும் எனவும் கூறப்படுகிறது.
இது குறித்து ஸ்ரீ செல்லாண்டியம்மன் கோயில் நற்பணி மன்றத் தலைவர் எம்.செல்லமுத்து கூறியது:
கடந்த 40 ஆண்டுகளுக்கு முன் காலி மனையிடங்களாக இருந்த 10.87 ஏக்கர் நிலத்தை பலர் தொழில் செய்வதற்காக கோயில் நிர்வாகத்திடம் இருந்து வாடகைக்குப் பெற்றனர். தொடர்ந்து முறையாக வாடகை செலுத்தி வந்தவர்கள் பிறகு தவணை தவறியும், அதன் பிறகு வாடகை செலுத்தாமலும் இருந்தனர். இவர்கள் மீது துறை அதிகாரிகள் முறையான நடவடிக்கைகளை எடுக்கவில்லை.
பல ஆண்டுகளாக பெரும்பாலான வாடகைதாரர்கள் வாடகை செலுத்தாமல் உள்ளனர். தற்போதைய வாடகை பாக்கி மட்டும் ரூ.4 கோடிக்கும் மேல் உள்ளது. சிலர் குறைந்த வாடகையை அறநிலையத் துறைக்கு செலுத்திவிட்டு மாதம் ரூ.15 ஆயிரம் முதல் ரூ.40 ஆயிரம் வரை கடைகளை உள்வாடகைக்கு விட்டுள்ளனர். சில வாடகைதாரர்கள் கோயில் பெயரில் இல்லாமல், தங்களது பெயரில் சொத்துவரி செலுத்தியுள்ளனர்.
இதனால் பல கோடி ரூபாய் மதிப்புள்ள கோயில் சொத்து பறிபோகும் நிலையில் உள்ளது. இந்த விவகாரத்தில் அரசு நேரடியாகத் தலையிட்டு, கோயிலுக்குச் சொந்தமான சொத்துகளை மீட்க நடவடிக்கை எடுக்க வேண்டும் என்றார்.
இது குறித்து கோயில் செயல் அலுவலர் (பொ) இரா.சுகுமார் கூறியது:
கோயில் சொத்தை ஆக்கிரமித்திருப்பவர்கள், வாடகை செலுத்தாதவர்கள் குறித்த பட்டியலும், வாடகை பாக்கி குறித்த முழு விவரங்களும் சேகரிக்கப்பட்டு வருகிறது. முழுவிவரமும் கிடைத்தவுடன் ஆக்கிரமிப்புப் பகுதிகளை மீட்க பாரபட்சமின்றி சட்டப்படியான நடவடிக்கைகளை அறநிலையத்துறை எடுக்கும் என்றார்.
பெருந்துறையில் பல ஆண்டுகளாக தனியார் ஆக்கிரமிப்பில் இருந்த அரசுக்குச் சொந்தமான 1.25 ஏக்கர் நிலத்தை, கடந்த மாதம் வருவாய்த்துறை அமைச்சர் தோப்பு என்.டி.வெங்கடாசலம் மீட்டு அரசிடம் ஒப்படைத்துள்ளார்.
இதேபோல் அறநிலையத் துறைக்குச் சொந்தமான ரூ.300 கோடி மதிப்புள்ள இந்த சொத்தையும் முதல்வரின் கவனத்திற்கு எடுத்துச் சென்று, அமைச்சர் மீட்டுத்தர வேண்டும் என பொதுமக்கள் கோரிக்கை விடுத்துள்ளனர்.

கோவிலுக்குச் சொந்தமான 6,000 பசுக்கள் மாயம் : தணிக்கையில் அம்பலம்

திருச்செந்தூர் கோவிலுக்கு, தானமாக வழங்கப்பட்ட, பசுக்களில், 5,000 பசுக்கள் மாயமாகியுள்ளது, தணிக்கைத்துறை ஆ#வில் தெரியவந்துள்ளது. தமிழகத்தில் உள்ள மற்ற கோவில்கள் குறித்து ஆய்வு செய்யப்பட்டால், இந்த எண்ணிக்கை, 6,000 ஆக உயரும். திருச்செந்தூரில் தனியார் @காசாலைகளுக்கு வழங்கப்பட்ட, இந்த பசுக்கள் குறித்து, அதிகாரிகள் கண்டு கொள்ளாமல் விட்டுவிட்டதால், அவை விற்பனை செ#யப்பட்டிருப்பதாக, புகார் எழுந்திருக்கிறது.கோவில்களுக்கு பசுக்களை தானமாக வழங்குவதை, பக்தர்கள் புனிதமானதாக கருதுகின்றனர். இவ்வாறு பக்தர்கள் வழங்கும் பசுக்கள், @காவில் நிர்வாகத்தால் அமைக்கப்படும், "@காசாலை'கள் மூலம் பராமரிக்கப்பட்டு வருகின்றன.

ERODE: The district administration has sent proposals to the State Tourism Department to develop six places as tourist spots. District Collector R. Sudalaikannan told The Hindu that the administration had suggested development of Kulavilakku Amman Temple in Nanjai Kalamangalam Temple, near Erode, place where the annual horse fair takes place near Anthiyur, Erode V.O.C. Park, Gunderipallam Dam in Gobichettipalayam taluk, Kalingarayan Dam near Bhavani, Perumpallam Dam in Sathyamangalam taluk and River Bhavani banks in Sathyamangalam. He said the move followed the department's efforts to promote tourism by funding infrastructure development in places that were not popular but had the potential to evolve as tourist spots. To develop the Kulavilakku Amman Temple, the administration has sought Rs. 3 crore to construct an arch, cement top the road leading to the temple, build jetty, dorms, etc. It has said that development of the temple located on River Cauvery banks will increase tourist inflow, as it is close to the famous Nattateeswarar Temple and Kodumudi. For the Erode V.O.C. Park project, the administration has asked for Rs. 1 crore to lay a new pathway, install a fountain and landscape the 16.9 acres, install another fountain at the children's park in the vicinity and others. The administration has asked for Rs. 15 lakh to construct public convenience facilities, shelters with seating arrangements, provide drinking water, place ornamental bins and erect ornamental arches at a place closer to the annual horse fair in Anthiyur. It has told the department that the facilities will be provided in such a way that not only during the five-day annual Gurunathaswamy Temple festival but round-the-year people make use of those. The proposal to develop Gunderipallam Dam says the administration at Rs. 46.20 lakh will develop a park, construct toilets, shelters, landscape the area surrounding the dam, construct overhead tank to supply drinking water, set up ticket counters and make other arrangements to welcome more tourists. It says tourists who go to the dam from Coimbatore, Tirupur and parts of Erode hardly have any facilities. The administration proposes to take up similar work at Kalingarayan Dam near Bhavani to invite tourists and pilgrims to visit Sangameswarar Temple there. The cost of the project to be taken up is Rs. 77 lakh. Similar is the proposal sent to develop Perumpallam Dam. Mr. Sudalaikannan says the aim is to bring in more places in the district on the tourist map and project Erode as a popular destination.

இந்து மடாலய நியமனங்களில் அரசுக்கோ அறநிலையத்துக்கோ எந்த அதிகாரமும் இல்லை: ஆலய வழிபடுவோர் சங்கம்

மதுரை ஆதீன விவகாரத்தில், மடாலய நியமனங்களில் அரசுக்கோ அறநிலையத்துறைக்கோ எந்த உரிமையும் அதிகாரமும் இல்லை; மேலும், சட்டத் திருத்தம் குறித்து பெஞ்ச் கூறியதை மறுஆய்வு செய்ய நீதிமன்றத்தை அணுக ஆலய வழிபடுவோர் சங்கம் முடிவு செய்துள்ளது. இது குறித்து அந்த அமைப்பு அனுப்பியுள்ள செய்திக் குறிப்பில் இதனைக் குறிப்பிட்டுள்ளது.

அந்த செய்திக் குறிப்பு:

மதுரை ஆதீனத்தில்  நித்தியானந்தா இளைய சந்நிதனமாக நியமனம் செய்ததை எதிர்த்து சென்னை உயர் நீதி மன்றத்தில் தொடுக்கப்பட்ட ரிட் பெடிஷன்களில் நீதிபதிகள் பானுமதி, சுப்பையா அடங்கிய பெஞ்ச் அளித்த தீர்ப்பின் சாராம்சம் என சொள்ளப்படுவனவற்றை ஊடகங்கள் வாயிலாக அறிந்து கொண்டோம்.

இந்நியமனம் குறித்து மதுரை சிவில் நீதிமன்றங்களில் வழக்குகள் நிலுவையில் உள்ளனவால், ரிட் பெட்டிஷன்களில் எந்த உத்தரவையும் நாங்கள் அளிக்க விரும்பவில்லை என்று நீதிபதிகள் கூறி உள்ளதை நாங்கள் வரவேற்கிறோம். 

அதே சமயம், அறநிலையத் துறை ஆணையருக்கு மடங்களை கூடுதலாகக் கட்டுப்படுத்தும் வகையில் கூடுதல் அதிகாரங்கள் வழங்க மாநில அரசு பரிசீலிக்கலாம் என நீதிபதிகள் கூறி உள்ளது தவிர்க்கப்பட்டிருக்க வேண்டும்.

மடாதிபதிகளின்  பொறுப்புகளை நிர்வாகம், சமயம் என பிரித்துப் பார்க்க இயலாது என்பதை சென்னை உயர் நீதிமன்றமும்,உச்ச நீதிமன்றமும் தம் முந்தையத் தீர்ப்புகளில் மிகத் தெளிவாக நிறுவி உள்ளன. மடாதிபதி என்பவர் ஓர் சாதாரண அறங்காவலர் அல்லர். அவருடைய நிலை அறங்காவலரின் நிலையை விட மிகவும் மேம்பட்டது என்றும் இந்நீதிமன்றங்கள் ஆணித்தரமாக எடுத்து உரைத்துள்ளன.

மேலும் ஒவ்வொரு மடமும் ஒரு தனி மதச் சமூகம் ஆகும்.  இஸ்லாமிய, கிறிஸ்துவ தனி  மதச் சமூங்கள் போல் அவற்றிற்கும்  அரசியல் நிர்ணயச் சட்டம் பிரிவு 26 ன் கீழ் விசேட பாதுகாப்புகள் கொடுக்கப்பட்டுள்ளன. அத்தகைய தனி மதச் சமூகங்களை அரசு கையகப் படுத்த முடியாது. 

தமிழ்ச் சைவ சமயத்திற்கு சிறிதும் சம்பந்தம் இல்லாத நித்யானந்தாவை தனக்கு வாரிசாக மதுரை ஆதீனகர்த்தர் நியமனம் செய்ய முயன்றதை நாங்கள் வன்மையாகக் கண்டிக்கிறோம். அதே சமயம் அந்நியமனம் குறித்து கேள்வி எழுப்ப அறநிலையத் துறைக்கோ அரசுக்கோ எந்த அதிகாரமும் உரிமையும் கிடையாது. கிறிஸ்துவ, இஸ்லாமிய மதத் தலைவர்களை அவர்கள் மத நிலையங்களில் நியமனம் செய்யப் படும்  போது குறுக்கிடாத அரசு இந்து மத நிலையங்களிலும் அவ்வாறே குறுக்கிடாமல் இருத்தல் வேண்டும். இந்த பெஞ்சின் தீர்ப்பில் சட்டத் திருத்தம் குறித்து கூறப்பட்டவைகளை மறு ஆய்வு செய்ய ஆலய வழிபடுவோர் சங்கம் நீதிமன்றத்தை அணுகும்.
